Welcome to LastWords (hereinafter referred to as "this Application" or "this Service"). These Terms of Service (hereinafter referred to as "this Agreement") constitute a legal agreement between you and the operator of LastWords regarding your use of this Application and related services. Please read all terms of this Agreement carefully. By registering, logging in, or using this Application, you acknowledge that you have read and agree to be bound by this Agreement. If you do not agree with any term of this Agreement, please immediately stop using this Service.
We reserve the right to revise this Agreement as needed. The revised Agreement will be published within the Application and will replace the original Agreement upon publication. If you continue to use this Service, you are deemed to have accepted the revised Agreement.
2.1 "User" refers to any natural person, legal entity, or other organization that registers, logs in, and uses this Application.
2.2 "Whispers" refers to text content created and edited by users, with delivery conditions and recipients set, including titles and body text.
2.3 "Recipient" refers to contacts designated by users who can receive users' whispers when specific conditions are met; they can be set as whisper recipients, trusted contacts, or both.
2.4 "Starlight Messages" (Public Whispers) refers to whispers that users may choose to make public on the Application's public board when specific conditions are met; publication can be anonymous or attributed.
3.1 You must provide truthful, accurate, and complete registration information (including but not limited to email, nickname, password) and update it promptly. You bear all consequences arising from providing untrue information or failing to update information in a timely manner.
3.2 You must properly safeguard your account and password and are responsible for all actions taken under your account. If you discover that your account has been compromised or there are abnormalities, you should immediately notify us and cooperate with us in taking appropriate measures.
3.3 You may not lend, transfer, sell, or otherwise allow others to use your account. We reserve the right to suspend or terminate an account if we reasonably suspect such circumstances exist.
4.1 This Application provides users with features including whisper recording, recipient management, delivery condition settings, delivery, and (optional) public sharing on Starlight Messages. Specific features are subject to actual product offerings, and we reserve the right to adjust the scope and rules of features according to business needs.
4.2 You should use the Service in accordance with the processes and rules provided by this Application, including but not limited to: properly setting recipients, truthfully setting delivery conditions, and editing submitted whispers within the specified number of times. You understand and agree that whispers will be automatically delivered or made public according to rules when conditions you set are met (such as lost contact determination, trusted contact confirmation, etc.), and this process may involve cooperation between the system and third parties (such as email services).
4.3 You may not use this Service to create, copy, publish, or disseminate content that violates laws and regulations or infringes upon the legitimate rights and interests of others, nor may you use this Service to engage in fraud, harassment, privacy invasion, or other behaviors. We reserve the right to handle violations and content, and retain the right to report to relevant authorities and pursue legal liability.
The intellectual property rights of the Application's interface design, copywriting, logos, technical architecture, etc. (excluding user-uploaded content) belong to the operator of LastWords or relevant rights holders. Without our written permission, you may not use, modify, copy, or use for commercial purposes. The copyright of whispers you create in this Application belongs to you; you grant us the right to use, store, and transmit your content to the extent necessary to provide services.
We value your privacy and data security. The methods and scope of collecting, using, storing, and protecting personal information are subject to our Privacy Policy. Please read and understand the Privacy Policy before using this Service. Using this Service indicates that you consent to our processing of your personal information in accordance with the Privacy Policy.
On mobile devices (including Android), system permissions such as camera, microphone, and media access are described in the Privacy Policy (e.g. Section 1.4).
7.1 This Service is provided "as is." We will make every effort to ensure service stability and data security, but cannot guarantee uninterrupted, error-free, or absolutely secure service. We are not responsible, to the extent permitted by law, for delays, failures, or data anomalies caused by networks, devices, third-party services, etc.
7.2 Whisper delivery and publication depend on recipient information you fill in, delivery conditions, and normal operation of the system and third-party services. You understand and accept that: incorrect, unverified, or invalid recipient email addresses may result in non-delivery; lost contact determination, trusted contact confirmation, and other rules are executed according to product design, and we are not responsible for rule understanding differences or whether execution results meet your personal expectations.
7.3 You are responsible for all content you create and submit in this Application. We are not responsible for the legality, truthfulness, or accuracy of user content, nor are we responsible for any disputes or third-party claims arising from user content.
To the maximum extent permitted by law, we and our affiliates and partners are not liable for any direct, indirect, incidental, derivative, or punitive damages (including but not limited to data loss, loss of profits, business interruption) arising from the use or inability to use this Service, and our total liability does not exceed the amount you have paid us for using this Service in the past twelve months (zero if no payment was made).
9.1 We reserve the right to change, suspend, or terminate part or all of the Service according to changes in laws and regulations or business needs, and will notify users in advance whenever possible. If you continue to use this Service after this Agreement is revised, you are deemed to have accepted the revised Agreement.
9.2 If you violate this Agreement or relevant laws and regulations, we reserve the right to suspend or terminate your account and services, and to delete violating content.
9.3 You may stop using this Service at any time and apply for account deactivation (subject to deactivation methods provided in the product). After deactivation, we will process your data in accordance with the Privacy Policy and legal provisions.
The conclusion, effectiveness, interpretation, and dispute resolution of this Agreement shall be governed by the laws of the People's Republic of China (excluding conflict of laws). Any disputes arising from this Agreement or this Service shall be resolved through friendly negotiation between both parties; if negotiation fails, either party may submit the dispute to a people's court with jurisdiction at our domicile for litigation.
11.1 If any provision of this Agreement is found to be invalid or unenforceable, it shall not affect the validity of other provisions.
11.2 Our failure to exercise or delay in exercising any right under this Agreement does not constitute a waiver of that right.
